1. Acceptance of Terms & Modifications

By accessing, browsing, registering for, or otherwise using Velvet, you affirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.

We reserve the right to revise or update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice through the Service. Your continued use of Velvet following the posting of updated Terms constitutes your acceptance of the revised Terms.

2. Age Restriction (18+ Only)

Velvet contains mature romance, drama, and fiction themes intended exclusively for adult readers.

You must be at least 18 years old (or the legal age of majority in your jurisdiction, whichever is greater) to access Velvet, create an account, purchase coins, or subscribe. Individuals under 18 years of age are strictly prohibited from using the Service.

3. User Accounts & Security

You may browse sample stories as a guest or create an account by authenticating through Google, Facebook, Apple, or email.

• Accurate Information: You agree to provide true, accurate, and current information when signing in and to maintain the accuracy of your details.
• Account Security: You are solely responsible for safeguarding your login credentials and for all activities that occur under your account.
• Suspension & Termination: We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if you violate these Terms, engage in fraud, or harm the community.
• Account Deletion: You may delete your account at any time directly through the Velvet app by visiting Profile > Delete account. Deletion permanently erases your account data, library history, and unspent balances.

4. Virtual Coins & Unlocks

Velvet utilizes a virtual currency system comprising Coins and promotional Bonus Coins (collectively, "Virtual Goods") to unlock digital serialized chapters.

• No Cash Value: Coins and Bonus Coins are digital licenses with no monetary or real-world cash value. They cannot be redeemed, exchanged, or converted into fiat currency or legal tender.
• Non-Transferable: Coins are tied strictly to your individual account and may not be transferred, sold, gifted, or bartered to any other user or third party.
• Bonus Coin Expiration: Promotional Bonus Coins granted via daily check-in streaks, rewards, or promotional events may carry limited validity periods and will expire if not used within the stated promotional window.
• Standard Pricing: Chapters 1–8 are free, chapters 9–15 cost 15 coins each, and chapter 16 onward costs 25 coins each. Coins are sold at 1,000 coins for $13.98 USD.
• Long Novels & Short Stories: Long-novel chapters are always unlocked with Coins, including for subscribers. Short stories are free to read with an active subscription; without one, they follow the same chapter prices.
• Inactive Accounts: If an account remains completely inactive for more than 12 consecutive months, Velvet reserves the right to retire dormant records and unspent promotional rewards.
• Non-Refundable: Once purchased or unlocked, Virtual Goods and unlocked chapters are final and non-refundable, subject only to non-waivable statutory consumer rights.

5. Billing & Payment Terms

All purchases on Velvet are processed in United States Dollars (USD), where coins are sold at 1,000 coins for $13.98 USD. Velvet offers two kinds of purchase: Coins, which unlock long-novel chapters, and subscriptions ($3.98 per day, $12.98 for the first week then $25.98 per week, $51.98 per month, or $259.98 per year), which unlock every short story. Coin packs and subscription rates are clearly displayed prior to purchase.

• Taxes & Exchange Rates: Displayed prices may exclude local sales taxes, VAT, or foreign transaction fees imposed by your bank or payment provider.
• Third-Party Processors: Payments are securely processed through third-party platforms including Apple Pay, Google Pay, credit/debit card processors, and PayPal. Velvet does not directly store your complete credit card or payment card details.
• Payment Authorization: By selecting a coin pack or subscription plan, you authorize Velvet and its payment processors to charge your selected payment method for the full purchase amount immediately.

6. Intellectual Property & Limited License

All novels, stories, literary works, cover artwork, illustrations, graphics, logos, software, audio, and visual interfaces available on Velvet are the exclusive intellectual property of Velvet's operator or its content licensors, protected by international copyright, trademark, and trade secret laws.

Subject to your compliance with these Terms, Velvet grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and read content solely for your personal, non-commercial entertainment on compatible personal devices.

7. Prohibited Conduct

You agree that you will not, under any circumstances, engage in any of the following prohibited activities:

• Automated Scraping: Deploying spiders, crawlers, robots, scrapers, data-mining tools, or automated scripts to extract text, images, or metadata from the Service.
• Piracy & Unauthorized Redistribution: Copying, recording, reproducing, republishing, distributing, broadcasting, syndicating, or selling Velvet stories or illustrations.
• No AI Training: Using any text, story data, chapter content, artwork, or character descriptions from Velvet to train, fine-tune, test, or validate artificial intelligence models, machine learning algorithms, or large language models.
• Coin Exploitation: Exploiting software bugs, manipulating client-side state, using automated scripts to farm bonus coins, or participating in unauthorized coin arbitrage.
• Payment Fraud & Chargebacks: Using stolen payment credentials, engaging in unauthorized card usage, or initiating bad-faith or fraudulent chargebacks.

8. User-Generated Content & Comments

Velvet may allow users to post book reviews, comments, and chapter reactions ("User Content").

By submitting User Content, you grant Velvet a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to host, display, reproduce, adapt, and distribute your comments across our platforms.

You must not post content that is defamatory, abusive, harassing, obscene, hateful, discriminatory, infringing on third-party intellectual property, or otherwise unlawful. Velvet reserves the right to review, edit, filter, or remove any User Content at any time without prior notice.

9. Disclaimers & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

To the maximum extent permitted by applicable law, neither HERNING TYAS nor any agents or contractors acting for Velvet shall be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. In no event shall Velvet's total aggregate liability arising out of or related to these Terms or the Service exceed the amount you paid to Velvet in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

10. Indemnification

You agree to defend, indemnify, and hold harmless HERNING TYAS and any agents or contractors acting for Velvet from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from your access to or use of the Service, your User Content, your violation of these Terms, or your infringement of any intellectual property or rights of another party.

11. Governing Law & Dispute Resolution

These Terms and any dispute or controversy arising out of or relating to them shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law principles.

Any dispute, claim, or controversy shall be resolved exclusively through final and binding arbitration or competent courts within that jurisdiction. You agree to resolve any dispute on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
